North Carolina Court of
Appeals rules Greene County Commissioners must
consider socioeconomic impacts and alternative
sites to proposed landfillJune
5, 2001 - The NC Court of Appeals
has ruled favorably for Green Citizens for
Responsible Growth in the
Greene County landfill case. The court opinion
stated "...we construe N.C. Gen.
Stat. § 153A-136(c)(1999) to require a board of
commissioners to give careful and thorough
consideration to alternative sites for a landfill
within the County."
The "Environmental
Justice" statue requires the local
government to look at socioeconomic impacts if
the new landfill is within one mile of an
existing landfill.
Conservation Council of North Carolina, along with BREDL and the Environmental
Justice Network, had filed an amicus (friend of
the court) brief in support of the Greene
Citizens case.
