North Carolina citizens
have the right to refuse herbicide applications
on rights-of-ways
A coalition of citizens' groups, led by the
Agricultural Resources Center, including the
Southern Environmental Law Center, the Blue Ridge
Environmental Defense League, MooreForce and a
dozen individual petitioners reached an agreement
in 1998 with Carolina Power and Light , Duke
Power, Nantahala Power and Light and NC Power to
provide prior notice and the right to refuse
herbicide applications on rights-of-ways. As part
of the agreement, power companies will include
information in electric bills describing their
spray programs and explaining how customers can
refuse herbicide applications to their property.
The agreement requires the individual owner (or
tenant) to contact the utility and request the
right of refusal.
